Overview - Our Commitment to Intellectual Property Rights
GetRentacar.com ("GetRentacar") respects the intellectual property rights of others and expects its users to do the same. As a U.S.-based online platform that hosts user-generated content (vehicle listings and photos), GetRentacar qualifies as a "service provider" under the Digital Millennium Copyright Act (DMCA) and is entitled to the DMCA's "safe harbor" protections. In accordance with 17 U.S.C. Section 512, we respond expeditiously to valid claims of copyright infringement and will remove or disable access to allegedly infringing material on our site. We will also terminate the accounts of repeat infringers when appropriate. This public DMCA Takedown Policy explains how copyright owners can submit notices, how users can submit counter-notices if they believe content was removed in error, and how GetRentacar handles these reports in good faith.
How to Submit a DMCA Takedown Notice (For Copyright Owners)
If you believe that content on GetRentacar infringes your copyright, you (or your authorized agent) can send us a DMCA Notice of Claimed Infringement. To be effective, your notification must be in writing (email is acceptable) and include all of the following elements:
- Identification of the copyrighted work you claim is being infringed. Describe the work fully, or if multiple works are affected, provide a representative list of the copyrighted works.
- Identification of the infringing material on our site that you want removed. Please include the specific URL(s) of the exact page where the material is located to enable us to find the content.
- Contact information for you, the complaining party. Provide your name, mailing address, telephone number, and email address so we can reach you and so that the user who posted the content (the "alleged infringer") can contact you, if necessary.
- A statement of good faith belief: Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy and authority statement: Include a statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf.
- Your signature: A physical or electronic signature of the owner or person authorized to act on behalf of the owner of the copyright that is allegedly infringed. (You may type your full legal name as an electronic signature.)
Please ensure all six elements above are present; otherwise, we may not be able to process your request under the DMCA. You may use either English or your local language, but any notice not in English must include an English translation for us to process it effectively. Submitting a complete and accurate notice will help us address your claim promptly.

What Happens Next
Upon receiving your valid DMCA notice, GetRentacar will acknowledge receipt and act quickly to remove or disable access to the reported content. We will also notify the user who posted the material that a takedown notice was received and the content was removed. As part of this notice, we provide the user with a copy of your DMCA notice, including your contact information, so they understand the allegations and can respond (for example, via a counter-notification). Under the DMCA, we are required to remove content upon valid notice; please note that we cannot judge the legal merits of your claim beyond the presence of a valid notice - removal does not imply a definitive legal determination of infringement.
Counter-Notification - If Your Content Was Removed by Mistake
If you are a GetRentacar user and believe your content was wrongly removed or disabled due to a DMCA notice (for example, you believe it is not infringing or you have authorization), you have the right to send us a DMCA Counter-Notification. A counter-notice is a formal request to restore the material, and under 17 U.S.C. Section 512(g) it must include the following:
- Identification of the material that was removed: Describe the content that was removed or disabled and provide the location (URL) where the content appeared before it was removed. Be as specific as possible (include the listing URL or any relevant identifiers).
- Statement of good faith mistake: Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed. For convenience, you may use wording such as: "I swear, under penalty of perjury, that I have a good faith belief the material removed was due to mistake or misidentification."
- Your contact information: Provide your full name, current address, telephone number, and email address.
- Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district of your address (or for any judicial district in which GetRentacar may be found, if you reside outside the United States), and that you will accept service of process from the original complaining party (the person or company who sent the DMCA takedown notice) or their agent.
- Your signature: The counter-notification must be signed. You may provide a physical signature or an electronic signature by typing your name.
Please send your counter-notification to our Designated DMCA Agent (contact information provided above). You can email it with the subject "DMCA Counter-Notification". Ensure all the above information is included - an incomplete counter-notice will not be processed under the DMCA.
After You Submit a Counter-Notice
Once we receive a valid counter-notification, we will forward a copy of it to the original complainant (the party who sent the takedown notice) and inform them that we will restore the removed content within 10 business days. Restoration timeline: Unless the copyright owner files a court action seeking an injunction against the content, GetRentacar will generally restore the material (re-enable access) between 10 and 14 business days after receiving the counter-notice. If we receive notice that the complainant has filed a lawsuit before that period elapses, we will not restore the content, and the matter will need to be resolved by the courts. We will notify you if this happens.
Please Note: By submitting a counter-notice, you are swearing under penalty of perjury that your content was removed mistakenly or wrongfully. Do not submit a false counter-notification - misuse of this process can have legal consequences. If you are unsure about your rights, consider consulting an attorney.
Repeat Infringer Policy
In accordance with the DMCA (17 U.S.C. Section 512(i)) and our Terms of Service, GetRentacar has adopted a policy to terminate user accounts that are deemed to be repeat infringers in appropriate circumstances. This means that if a user repeatedly posts content that is subject to legitimate DMCA takedown notices, we may suspend or delete their account and/or prevent them from using our platform. GetRentacar will track DMCA notices and strive to identify users who have multiple infringement strikes. When warranted - for example, after multiple violations or a pattern of infringing behavior - such users will have their account privileges revoked. We take this policy seriously to protect copyright owners' rights and to retain our safe harbor protections under the DMCA.
Account Termination: If your account is terminated under this policy, you will be notified. If you believe your account was wrongly identified as a repeat infringer, you may contact us (or submit an appropriate counter-notice if applicable) to request review, but please be aware that we must enforce a reasonable repeat infringer policy to remain in compliance with the law.
Platform Responsibility and Legal Disclaimer
User-Generated Content: GetRentacar is a platform that allows third-party users to upload and post content. We do not actively monitor or pre-screen all content posted by users. As a result, we are not responsible for user-uploaded content that may infringe copyrights, unless we are properly notified. All users are contractually obligated to ensure they have the rights to the content they post.
Good-Faith Takedowns: GetRentacar will remove or disable access to content in response to valid DMCA notices in good faith, to comply with our legal obligations. Under the DMCA, we are not liable to the user for taking down content in response to a proper notice of infringement, regardless of whether the material is ultimately found to be infringing or not. Our actions under this policy are intended to preserve our safe harbor protections and do not constitute legal determinations on the infringement claim.
No Guarantee of Accuracy: While we strive to assist all parties in this process, GetRentacar cannot provide legal advice to users or copyright owners. It is the responsibility of the complaining party to ensure their DMCA notice is valid and the responsibility of the user to ensure their counter-notice is valid. We cannot adjudicate disputes - we can only apply the DMCA procedures. Any further dispute must be resolved between the copyright owner and the user (potentially in court).
Misrepresentations and Abuse: Knowingly misrepresenting that material on our site is infringing, or that material was removed by mistake, is a violation of the law. Federal law (DMCA Section 512(f)) imposes liability for damages (including costs and attorneys' fees) on any person who sends a false notice or counter-notice in bad faith. This means you may be held legally responsible if you intentionally abuse the DMCA process. GetRentacar reserves the right to seek damages or other remedies from any party that submits fraudulent or knowingly false claims of infringement or counter-claims. Abuse of the DMCA notice system (by submitters or users) may also result in account suspension or other legal action. These procedures are exclusively for copyright issues - do not use this policy to report other legal claims or abuses unrelated to copyright.
Third-Party Content and Other IP: This policy addresses copyright infringement issues. If you have a concern about non-copyright issues (such as trademark infringement, defamation, etc.), please contact us through our regular customer support or legal channels - those issues are handled outside of the DMCA process. We treat all third-party content on our site in accordance with applicable laws, but different types of claims have different procedures.
Reservation of Rights: GetRentacar reserves the right to modify or update this DMCA Policy at any time. Changes will be posted on this page with a new "Last Updated" date. It is your responsibility to review this policy periodically for updates.
